SMS Terms of Service

Program: Bernhardt Riley, PLLC — Client & Prospect SMS Communications | Effective: June 1, 2025 | Last updated: March 2026

Bernhardt Riley, PLLC (“the Firm,” “we,” “us,” or “our”) operates an SMS messaging program to communicate with clients and prospective clients. These Terms govern your participation in that program. Consent to receive SMS is entirely optional and is never required to submit a contact form or receive legal services from this Firm.

1. Program Description

By opting in, you may receive two categories of SMS messages from Bernhardt Riley, PLLC:

Category	Message types
Non-marketing (transactional / client care)	Case status updates, appointment reminders and confirmations, intake confirmations, document request notifications, deadline reminders, and responses to your direct inquiries.
Marketing	Firm news and announcements, legal updates relevant to your practice area, event invitations, and general promotional information about the Firm’s services.

You may opt in to one category, both, or neither. Your choices are recorded at the time of form submission.

2. Message Frequency & Rates

Message frequency varies based on your matter and your opt-in selections. Non-marketing messages are sent as needed in connection with your active matter or inquiry. Marketing messages are sent periodically and infrequently.

Message and data rates may apply. If you have questions about your text plan or data plan, contact your wireless carrier directly.

3. How to Opt In

You may opt in to SMS communications by checking the appropriate consent checkbox(es) on any contact or intake form on brflorida.com. Checking the checkbox constitutes your express written consent to receive the category of messages described in that checkbox.

Consent is not a condition of any purchase, engagement, or receipt of legal services from Bernhardt Riley, PLLC.

4. How to Opt Out (STOP)

You may cancel your SMS subscription at any time. To stop receiving messages, reply STOP to any message you receive from us. After sending STOP, you will receive a single confirmation message and no further SMS messages will be sent, unless you re-subscribe.

The following keywords are all recognized and will unsubscribe you immediately:

STOP CANCEL UNSUBSCRIBE QUIT END

To re-subscribe after opting out, reply START or YES to any prior message from us, or complete a new opt-in form on our website.

6. Data & Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services used to operate this program.

Information sharing with subcontractors that support our services — such as customer service providers and technology vendors — is permitted under appropriate confidentiality obligations.

7. Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is subject to your carrier’s network availability and coverage. Bernhardt Riley, PLLC is not responsible for any delays or failures in message delivery caused by your carrier or network conditions.

8. Age Requirement

You must be 18 years of age or older to participate in this SMS program. By opting in, you represent and warrant that you are at least 18 years old and are the account holder or have the account holder’s permission for the mobile number you provided.

9. Changes to These Terms

We may update these SMS Terms of Service from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Your continued participation in the SMS program after any changes are posted constitutes your acceptance of the revised Terms.
